1. Acceptance of Terms

By accessing or using GDD Pro (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Service Description

GDD Pro provides Growing Degree Days calculations and analysis tools using historical weather data. The Service includes weather station selection, GDD calculations, data visualization, threshold monitoring, and data export capabilities.

3. User Accounts

3.1 Account Creation

You may use certain features anonymously or create an account for additional functionality. When creating an account, you must:

  • Provide accurate and complete information
  • Maintain the confidentiality of your account credentials
  • Be at least 16 years of age
  • Not create accounts for others without authorization

3.2 Account Responsibilities

You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breach.

3.3 Account Types

Anonymous Access. Limited functionality with session-based data storage only.

Registered Account. Full access to Service features including data persistence, multiple locations, historical comparisons, and alert notifications.

4. Acceptable Use

4.1 Permitted Use

You may use the Service for lawful purposes consistent with these Terms and applicable laws.

4.2 Prohibited Conduct

You may not:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to any portion of the Service
  • Interfere with or disrupt the Service or servers
  • Circumvent any access restrictions or Service limitations
  • Use automated means to access the Service without our express permission
  • Resell, redistribute, or sublicense the Service or its data
  • Misrepresent your affiliation with us or the Service
  • Use the Service to harm minors in any way
  • Transmit any malicious code or conduct any security testing without permission

5. Service Content and Data

5.1 Weather Data

The Service utilizes Global Summary of the Day (GSOD) historical weather data. This data is provided for informational purposes only. Data quality and completeness vary by station and time period.

5.2 Disclaimers

THE SERVICE PROVIDES HISTORICAL WEATHER DATA AND CALCULATIONS WITHOUT WARRANTIES OF ANY KIND. The Service:

  • Does not provide real-time weather forecasts
  • Should not be the sole basis for critical agricultural or business decisions
  • Does not constitute professional agricultural advice
  • May contain inaccuracies or errors

5.3 User Content

You retain ownership of data you input into the Service. By using the Service, you grant us a limited license to process and display your data as necessary to provide the Service.

6. Intellectual Property

6.1 Service Materials

The Service and its original content, features, and functionality are owned by us and are protected by intellectual property laws.

6.2 Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by us without obligation to you.

7. Third-Party Services

The Service integrates with third-party services including:

  • Google for authentication
  • Google Places API for location services
  • Resend for email communications
  • Microsoft Azure for hosting

Your use of third-party services is subject to their respective terms and policies.

8. Limitation of Liability

8.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 Limitation of Damages

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100) IN AGGREGATE.

8.3 Agricultural Activities

You acknowledge that agricultural activities involve inherent risks and uncertainties. We are not responsible for crop performance, yield outcomes, or economic losses related to agricultural decisions.

9. Indemnification

You agree to defend, indemnify, and hold harmless GDD Pro and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, violation of these Terms, or violation of any rights of another party.

10. Dispute Resolution

10.1 Informal Resolution

You agree to attempt to resolve any dispute informally by contacting us before initiating any formal proceedings.

10.2 Arbitration Agreement

Any dispute not resolved informally shall be resolved through binding arbitration conducted by the American Arbitration Association under its Commercial Arbitration Rules.

10.3 Class Action Waiver

You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

10.4 Governing Law

These Terms shall be governed by the laws of Arizona, without regard to its conflict of law provisions.

11. Modifications

11.1 Terms Changes

We reserve the right to modify these Terms at any time. Material changes will be notified via email or Service notice with reasonable advance notice.

11.2 Service Changes

We may modify, suspend, or discontinue any aspect of the Service at any time without liability to you.

12. Termination

12.1 Termination by You

You may terminate your account at any time through account settings or by contacting us.

12.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, for:

  • Breach of these Terms
  • Conduct that we believe violates applicable law
  • Conduct harmful to other users or the Service
  • Extended periods of inactivity

12.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall survive.

13. General Provisions

13.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and GDD Pro.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force.

13.3 Waiver

Our failure to enforce any right or provision shall not be deemed a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign our rights and obligations without restriction.
